
HOS Update
INTERIM FINAL RULE ISSUED DECEMBER 11, 2007
The FMCSA issued an Interim Final Rule (IFR) on Dec. 11, 2007, keeping in place the current HOS rules regarding the 11 hours driving and 34 hour restart. The agency issued the new hours of service rule in response to the recent decision by the D.C. Circuit Court of Appeals vacating key provisions of the existing hours of service rules effective on December 27. In order to ensure no gap in coverage of these important safety rules, the ruling temporarily reinstates those two provisions while the agency gathers public comment on its actions and the underlying safety analysis before issuing a final rule. PUBLIC COMMENT PERIOD EXTENDED
The Federal Motor Carrier Safety Administration has announced that the public comment period on the commercial motor vehicle drivers' hours-of-service Interim Final Rule has been extended until March 17, 2008, to provide interested parties an opportunity to provide further comment and supporting data.
Unified Carrier Registration Agreement
2008 UNIFIED CARRIER REGISTRATION AGREEMENT
ALL MOTOR CARRIERS PLEASE READ CAREFULLY
The Unified Carrier Registration Agreement (UCRA) was established by federal law to replace the Single State Registration System.
What companies are subject to the UCRA fees? The UCRA requires ALL interstate motor carriers required to register with the United States Department of Transportation (USDOT), including private, for hire and exempt carriers - as well as interstate brokers, freight forwarders, and leasing companies - to file and pay fees under this program.
What entities are not subject to the UCRA fees? Intrastate motor carriers are not subject to UCRA per se, unless a state that participates in URCA elects to extend the requirements of UCRA to its intrastate carriers.
What equipment do I have to claim? ALL vehicles over 10,000 lbs GVWR, including power units, buses, towed units (trailers), and straight trucks must be registered. All applications must be filed with the States before the enforcement date of June 1, 2008. Compliance for this will be closely monitored by the authorities and will be accessible by roadside enforcement officials.
